TMJ dysfunction is a painful injury to the jaw which is common in Motor Vehicle Accidents. People who suffer TMJ injuries often require additional physiotherapy and splint therapy and need special dental attention. Cuming & Gillespie is pleased to report that a recent Alberta Case named Sparrowhawk has ruled that TMJ injuries are not subject to the “Cap” on pain and suffering damages.
Albertan’s who have suffered TMJ injuries are entitled to fair and reasonable compensation based on precedent decisions and are not limited by artificial legislative Caps. If you have suffered a TMJ injury contact Cuming & Gillespie to discuss your options.
