Cuming and Craig G. Gillespie, resolved through a Judicial Mediation after extensive litigation for the full amount of the Defendant’s insurance policy plus costs, plus a very significant contribution from the client’s own (SEF) Insurer. The couple were extremely happy with the hard fought resolution of the claim and the level at which it resolved.

Cuming, Gillespie & Raymaker are proud to announce that they successfully resolved a claim for a couple who were stuck head on in a collision for the full insurance policy limits of the Defendant driver. In addition to the full insurance policy limits of the Defendant driver, the clients’ own (SEF) Insurer also contributed a very significant sum to resolve the couples’ claims. This case, which was handled by James Cuming, was litigated for a number of years prior to a resolution through the dispute resolution process at the Alberta Court of Queen’s Bench. Our clients were extremely happy with the hard fought resolution of the claim and the maximum level at which it resolved.

The matter resolved for a very significant (and confidential) sum. Gillespie of Cuming, Gillespie & Raymaker are very pleased to announce that in December, 2007, a claim for a motorcyclist who was struck by a left turning driver was resolved for a high six figure settlement. The motorcyclist suffered significant orthopedic and neurological injuries, and resolved very well from his significant injuries. Our client is currently employed with a voluntary organization and is able to assist others who have suffered significant loss and injury similar to his own. The matter was resolved through an independent mediation with the assistance of David Stark of Calgary as a mediator. We thank Mr. Stark for his commitment and involvement to the matter as well.

Energy Case Verdict

Cuming, Gillespie & Raymaker received a favorable Judgement from the Alberta Court of Appeal in the Amethyst Petroleum vs. Primrose Drilling matter. The appellate team of Bill McNally and Kent Anderson of Miller Thomson LLP were successful in arguing that the Queen’s Bench trial decision of Mr. Justice G.C. Hawco be upheld. Justice Hawco found that the Plaintiff company was entitled to 20% of the net profit of 2 producing oil wells.

The matter will likely proceed to a quantum trial in 2008.

Professional Negligence

The trial team consisting of Bill McNally and Pamela Fischer were successful in obtaining a trial judgment involving a misdiagnosed heart attack. The court found that the defendants conduct was below the accepted standard of care and caused the plaintiffs injuries. Six figure damages were agreed to prior to the trial.

McNally Cuming Raymaker Resolves Wrongful Death and Orthopedic Injury Claim

The family represented by McNally Cuming Raymaker, Alberta Injury Lawyers, for a claim arising from a motor vehicle collision in December of 2004, recently resolved their claim with a confidential out of court settlement.

The family had been proceeding on a rural highway in Alberta when their minivan was struck by a one ton truck operated by an impaired individual, whose passengers were actually drinking at the time of the collision. James Cuming of McNally Cuming Raymaker, Alberta Injury Lawyers, represented the injured survivors and the Estate for the deceased Plaintiff in the case. The claims were resolved through mediation to the satisfaction of the family of the deceased and the injured passengers less than three years after the collision occurred.
