Cuming & Gillespie received a favorable Judgement from the Alberta Court of Appeal in the Amethyst Petroleum vs. Primrose Drilling matter. The appellate team were successful in arguing that the Queen’s Bench trial decision of Mr. Justice G.C. Hawco be upheld. Justice Hawco found that the Plaintiff company was entitled to 20% of the net profit of 2 producing oil wells.

The matter will likely proceed to a quantum trial in 2008.

The family had been proceeding on a rural highway in Alberta when their minivan was struck by a one ton truck operated by an impaired individual, whose passengers were actually drinking at the time of the collision.
