Chronic Pain JDR

Cuming & Gillespie Lawyers successfully resolved a multi party injury claim where the plaintiff suffered from ongoing chronic pain. The matter was settled at a Judicial Dispute Resolution Conference and involved extensive input from the court. The details of the six figure settlement are confidential.

Energy Case Verdict

Cuming & Gillespie received a favorable Judgement from the Alberta Court of Appeal in the Amethyst Petroleum vs. Primrose Drilling matter. The appellate team were successful in arguing that the Queen’s Bench trial decision of Mr. Justice G.C. Hawco be upheld. Justice Hawco found that the Plaintiff company was entitled to 20% of the net profit of 2 producing oil wells.

The matter will likely proceed to a quantum trial in 2008.

Cuming & Gillespie Resolves Wrongful Death and Orthopedic Injury Claim

The family represented by Cuming & Gillespie, Alberta Injury Lawyers, for a claim arising from a motor vehicle collision in December of 2004, recently resolved their claim with a confidential out of court settlement.

The family had been proceeding on a rural highway in Alberta when their minivan was struck by a one ton truck operated by an impaired individual, whose passengers were actually drinking at the time of the collision. James Cuming of Cuming & Gillespie, Alberta Injury Lawyers, represented the injured survivors and the Estate for the deceased Plaintiff in the case. The claims were resolved through mediation to the satisfaction of the family of the deceased and the injured passengers less than three years after the collision occurred.
