Class Action Lawsuit – Outbreak of Shiga Toxin-Producing E. Coli at Calgary Daycare

Cuming & Gillespie LLP Barristers & Solicitors has issued a class action lawsuit against Fueling Brains, also known as Fueling Brains Academy, Fueling Minds, Braineer Academy, Kidz Space, Little Oak Education, Almond Branch School, and Vik Academy. 

The proposed Representative Plaintiff, Veronica DeCoste, is an infant who resides in Calgary, Alberta and brings this Action through her Litigation Representative and mother, Katherine McLean. 

The Representative Plaintiff brings this action on her own behalf and on behalf of all persons, other than the Defendants, who contracted E. Coli as a result of attending the daycare facilities owned and operated by the Defendants and being served food handled and prepared by the Defendants.

As a result of the negligent, unsanitary and unsafe food storage, preparation and handling practices of the Defendants, or one or any of them, the Representative Plaintiff and class members suffered from food poisoning due to E. Coli infection and became violently ill. The cases of E. Coli infection are connected to an outbreak of the Shiga toxin-producing E. Coli at the Defendants’ Daycares.

The Statement of Claim was filed on September 8, 2023 bearing Alberta Court of King’s Bench Action No. 2301 11825.
