Serious personal injury cases require a significant investment of time and resources. Medical evidence, expert reports, and other disbursements can create a heavy cost load for firms that don’t handle a large volume of personal injury work. However, clients may feel comfortable approaching a firm with which they already have an existing relationship or one closer to home.

As recognized leaders in the area of serious personal injury, motor vehicle accident claims and medical malpractice law, Cuming & Gillespie LLP has the resources and experience to handle complex personal injury cases. As a result, our team accepts case referrals from lawyers and law firms from across Canada and the United States, and pays referral fees to the referring lawyer as permitted under the Alberta Law Society Code of Conduct.

Referral Fees Offered for Referrals from Lawyers

Per Rule 3.6-6 of the Alberta Law Society Code of Conduct, a fee may be provided to a lawyer referring a file to another lawyer because of the other lawyer’s expertise and ability to handle the matter, so long as there is no conflict of interest. The referring lawyer may be paid a referral fee by the accepting lawyer, provided that:

  1. The fee is reasonable and does not increase the total amount of the fee charged to the client; and
  2. The client is informed and consents.

Cuming & Gillespie LLP offers referral fees in accordance with Rule 3.6-6 for any file referred to and accepted by our firm. We accept referrals on any of the cases usually handled by our firm, including serious/catastrophic personal injury cases, motor vehicle accidents, and medical malpractice claims.

Early Referrals Best for Protecting Client’s Care & Rights

Cuming & Gillespie LLP encourages lawyers needing to refer a client’s serious personal injury case to do so as early as possible in the file. Our team’s extensive experience enables us to identify care options that may have been previously unexplored by the client’s insurer or medical providers. By helping clients get timely, comprehensive care, we ensure the extent and nature of their injuries are properly documented as evidence for their claim. As a result, early referrals protect the client’s rights and entitlements and meet the legal standard for mitigating damages.
