Our managing partner, James D. Cuming, recently discussed the impact that non-pecuniary damage caps have on personal injury accident victims. Jamie notes that since Alberta’s last tort reform in 2004, when the cap for minor injuries was set at $4,000 ($5,080 now, with inflation), 85% of personal injury claims have been removed from the system without litigation being pursued.
